These terms govern your use of the Cayman Compliance Desk website at caymandesk.com and the regulations reference library at ditc.caymandesk.com. By using either site, you agree to them. If you do not agree, please do not use the sites.

1. About these sites

These sites are informational. They describe services the Cayman Compliance Desk offers or intends to offer — including flat-rate DITC reporting and on-island Principal Point of Contact (PPoC) representation — and provide a reference library of published Cayman regulatory material.

The client portal is not yet live. Descriptions of the portal and of planned services are statements of intent, not commitments, and may change before launch. Nothing on these sites is an offer capable of acceptance; services are provided only under a signed engagement.

2. No advice, and no client relationship

The Cayman Compliance Desk is a regulatory operations provider and is not a law firm. We do not provide legal advice. Our service covers data processing, XML schema generation, DITC portal management, and on-island PPoC representation.

Nothing on these sites — including the reference library, guidance summaries, deadline listings, and any output of the compliance diagnostic — constitutes legal, tax, accounting, or investment advice, or a legal opinion. It is general information that may not fit your circumstances. You should obtain advice from a qualified professional before acting on anything you read here.

Using these sites, submitting a form, or corresponding with us does not create a client, advisory, or fiduciary relationship. Such a relationship arises only when we have both signed a written engagement.

3. The regulations reference library

The reference library at ditc.caymandesk.com compiles publicly available material issued by the Cayman Islands Department for International Tax Cooperation (DITC) and other authorities, together with our summaries of it. Summaries are provided for convenience and are not a substitute for the source documents.

Regulatory requirements and deadlines change. We compile this material in good faith but do not warrant that it is current, complete, or accurate, and we are not responsible for errors or omissions in it. Always verify against the official DITC source before relying on it. Copyright in the underlying official publications remains with their respective issuers.

4. Submitting a form

When you submit a form on these sites, you confirm that the information you provide is accurate and that you are entitled to provide it — including where it relates to an entity you act for.

Please do not submit sensitive personal information, account holder data, or confidential documents through a web form. If you need to send us something of that nature, email us first and we will arrange a secure channel. Information you submit is handled in accordance with our Privacy Policy.

We aim to respond to enquiries promptly, but we do not guarantee a response or any particular response time, and submitting a form does not oblige us to take on your matter.

5. Acceptable use

You agree not to:

• use these sites for any unlawful purpose, or in breach of any applicable regulation;
• submit false, misleading, or fraudulent information through a form;
• attempt to gain unauthorised access to the sites, their servers, or any connected system;
• interfere with the operation of the sites, including by overloading or probing them;
• scrape, harvest, or systematically extract content, or use automated means to access the sites in a way that places unreasonable load on them;
• resell or commercially redistribute the reference library or any substantial part of it.

We may restrict or withdraw access to anyone who breaches these terms.

6. Intellectual property

The Cayman Compliance Desk name, logo, site design, and original written content are our property or are licensed to us. You may read, print, and share pages for your own reference or for the internal purposes of your organisation. You may not republish, sell, or present our content as your own, or remove attribution from it, without our written permission.

7. Third-party links

These sites link to third-party resources, including the DITC portal and official publications. We do not control those sites and are not responsible for their content, availability, or privacy practices. A link is not an endorsement.

8. Availability and disclaimer

We aim to keep these sites available, but we provide them "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We may change, suspend, or withdraw any part of the sites at any time without notice.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of these sites or your reliance on their content — including any regulatory penalty, missed filing deadline, loss of profit, loss of data, or indirect or consequential loss.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

10. Governing law

These terms are governed by the laws of the Cayman Islands. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of the Cayman Islands.

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect.

11. Changes to these terms

We may update these terms from time to time — in particular when the client portal launches. The "last updated" date at the top shows when the current version took effect, and your continued use of the sites after that date means you accept the updated terms.
